Terms of Service for MonkmanStudios

Welcome to MonkmanStudios! These terms of service govern your use of MonkmanStudios.com and any other related services offered by MonkmanStudios (the "Services"). By accessing or using our Services, you agree to be bound by these terms of service, as well as our Privacy Policy, which is incorporated into these terms by reference.

  1. Acceptable Use of Services You agree to use our Services only for lawful purposes and in accordance with these terms of service. You may not use our Services:
  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, or any other form of solicitation.
  • To impersonate or attempt to impersonate MonkmanStudios, a MonkmanStudios employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by MonkmanStudios, may harm MonkmanStudios or users of the Services, or expose them to liability.

  1. Intellectual Property The content, features, and functionality of the Services, including but not limited to all information, software, text, displays, images, video, and audio, as well as the design, selection, and arrangement thereof, are the property of MonkmanStudios or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

  2. User Content The Services may allow you to submit, upload, publish or otherwise make available content (including but not limited to text, images, video, and audio) (collectively, "User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Services.

 

Warranties Terms of Service for Monkman Studios

  1. Limited Warranty Monkman Studios provides a limited warranty that the Services will be free from defects in material and workmanship for a period of thirty (30) days from the date of delivery. This limited warranty applies only to the original purchaser of the Services.

  2. Warranty Exclusions This limited warranty does not cover defects or damages resulting from: (i) improper installation or use of the Services; (ii) accidents, misuse, or abuse of the Services; (iii) unauthorized modification or repair of the Services; (iv) natural disasters, such as fire, flood, or lightning; (v) normal wear and tear; (vi) use of the Services for a purpose other than that for which they were designed; or (vii) failure to follow the instructions and guidelines provided by Monkman Studios.

  3. Remedies In the event of a breach of the limited warranty, Monkman Studios will, at its option, repair or replace the defective Services or refund the purchase price paid for the Services. This shall be the sole and exclusive remedy for any breach of the limited warranty.

  4. Disclaimer of Other Warranties EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, MONKMAN STUDIOS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  5. Limitation of Liability MONKMAN STUDIOS SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF MONKMAN STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  6. Exclusions and Limitations Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. To the extent that Monkman Studios may not, as a matter of applicable law, disclaim any warranty or limit its liability, the scope and duration of such warranty and the extent of Monkman Studios's liability shall be the minimum permitted under such law.

  7. Changes to Warranty Terms Monkman Studios reserves the right to modify or amend these warranty terms from time to time. Any such modifications or amendments shall be effective immediately upon posting of the revised warranty terms on the Monkman Studios website. Your continued use of the Services after the posting of any modified or amended warranty terms shall constitute your acceptance of such modified or amended warranty terms.
